Fields: Constitutional criminal procedure and law

Mr. Fiandach is a practicing defense attorney with American Bar Association Board Certification. Well known as a lecturer on legal issues, he has given over 400 lectures to lawyers' groups across North America and served as a panelist at a conference on Alexis de Tocqueville, where he discussed Tocqueville's views on lawyers. The author of four legal textbooks and hundreds of articles on legal issues, he has contributed numerous pieces for various legal publications and newspapers. He has authored several papers on Miranda v. Arizona, most significantly "Miranda Revisited" (2005), published in "The Champion," the journal of the National Association of Criminal Defense Lawyers, and "Mirandaat Fifty" (2016), published in the New York State Bar Association Criminal Justice Section Journal. Other articles include "The Good, the Bad and the Ugly," which discussed issues surrounding the use of body camera footage in a criminal trial and was also published in "The Champion" in 2024. In an earlier article, "The Great .08 Debate," which again, appeared in "The Champion," he statistically analyzed the effectiveness of reducing DWI per se blood levels to .08. Mr. Fiandach authored "The Constitutional Status of Slavery: A Lawyer's Interpretation" (2022), which was published in Vol. 84, No. 1 of The Albany Law Review. Most recently, Mr. Fiandach authored "The Future of American Rights," published in Vol. 22 No. 3 of the New York State Criminal Justice Section Reporter, a publication of the New York State Bar Association, which took a hard look at Constitutional parameters surrounding the background and implementation of rights litigation in light of recent changes in the United States Supreme Court. Professionally, Mr. Fiandach has tried more than 4,000 cases and has argued dozens of appeals in the Appellate Division, the New York State Court of Appeals and the Second Circuit Court of Appeals. Fiandach has been named a "Superlawyer" and recognized as a Best Lawyer. In his personal life he enjoys being a parent, a skier, reading and working out.
